The President took office on January 20th, 2025 and promptly signed a series of executive orders and a bill from Congress (the Laken Riley Act) which will dramatically change the outlook look of immigration. Below are some of the highlighted items from the order(s) and laws signed.
Protecting the American People Against Invasion
The executive order signed by President Trump on January 20th, 2025, does the following amongst other things:
- The expansion of expedited removal. This means the removal of aliens without expanded due process of law (for example the ability to remove an alien without hearing(s) or the ability to present defenses).
- The order directs the Department of Homeland Security to impose detention of everyone pending resolution of their cases. This means that during the pendency of the alien’s case he or she will be detained.
- The deputization of local law enforcement for the purpose of detaining individuals on behalf of Customs and Border Patrol (CBP) and/or Immigration and Customs Enforcement (ICE).
- The limiting of Temporary Protected Status and Humanitarian Parole.
Changes to Asylum
- The administration will eliminate the seeking of asylum at the US border. In the past individuals seeking asylum could “knock on the door” and request asylum at the US border and then be paroled in the United States.
Challenge to 14th Amendment
- The 14th Amendment. “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
- The Executive Order. President Trump issued an executive order claiming that a child born to either an undocumented mother and father is not a United States Citizen pursuant to the 14th
- Pending Lawsuits. The matter is being contested by eighteen (18) states and is currently enjoined from taking effect.
Temporary Protected Status (TPS)
- It will not be renewed for Venezuela.
- It is currently being reviewed for other countries.
Laken Riley Act
- This law is different from the Executive Order(s) signed by the President. This law was passed by Congress and signed into law by the President.
- Any person accused of theft and violent crimes will be detained with no bond to be issued.
- This changes the rule(s) for individuals facing accusations but NOT yet convicted of a crime.
