The Biden Program for “Parole in Place” is currently on hold for the processing of applications until Monday September 9th, 2024, due to a court case filed by the State of Texas v Department of Homeland Security, Case Number 24-cv-306.
On Monday September 9th, 2024, we will learn if the hold placed by the Court will continue or whether DHS will begin adjudicating applications for the Parole in Place Program.

USCIS announces Biden program to “parole in place” for the undocumented spouses and stepchildren of US Citizens. If you meet the requirements below, this program is for you:
- If you entered without inspection and are NOT admitted or paroled in the US;
- If you are present in the US since June 17th, 2014
- If you were married prior to June 17th, 2024
- If you have no disqualifying criminal history
- And you submit to a biometric fingerprinting and undergo a background check
